SB 53 WOULD REQUIRE YOU TO GIVE YOUR PERSONAL INFORMATION AND A THUMBPRINT TO THE STATE BEFORE YOU CAN BUY ANY AMMUNITION OF ANY KIND IN CALIFORNIA!
BELOW IS A SUMMARY OF HOW THIS UNWARRANTED BILL WOULD AFFECT YOU AND INFRINGE ON YOUR SECOND AMENDMENTS RIGHTS!!
SB 53 (de Leon) Ammunition: purchase permits – Would apply to all ammunition purchases (not just handgun ammunition) and would thus reinstate the following provisions of law that were previously enacted but did not take effect because of a court ruling that the definition of handgun ammunition used was unconstitutionally vague:
• Ammunition sales could only be made in a “face to face” transaction, thus making internet and mail order ammunition sales illegal (note: there is a new amendment that would exempt licensed hunters from the “face to face” provision, but their purchases would still have to be registered);
• The vendor would have to record personal information about the purchaser, including obtaining a signature and thumbprint, and
• The brand, type, and amount of ammunition purchased would be recorded for each transaction. The purchaser would then be checked by the Department of Justice to determine if he or she is prohibited from owning firearms and ammunition.
SB 53 would apply to all ammunition (rifle, shotgun, and handgun), including hunting ammunition. Ammunition offered for sale could not be on display in a location that is accessible to customers without the assistance of the vendor or a vendor employee.
Ammunition vendors would have to obtain an ammunition vendor license from the Department of Justice.
It appears that the hunter exemption from the face to face requirement came from the Fish and Game Commission and the Director of the Department, Chuck Bonham, in an effort to facilitate and expedite the implementation of the ban on traditional ammunition (AB 711) which the Director supported.
It seems there is a belief on their part that non-lead ammunition can readily be purchased over the internet, even though ammunition retailers in California are finding it very difficult to obtain. They have indicated publicly that they can find it in catalogs, like Cabelas, and seem to think it is easy to obtain simply by ordering it. Apparently, they have made no effort to find out if it is currently available.
This amendment, portrayed as a measure to help hunters, may actually hurt them, instead, by helping to assure that SB 53 is passed!!!
IT IS CRITICAL THAT SB 53 BE STRONGLY OPPOSED
THIS BILL WOULD DO NOTHING TO SOLVE PROBLEMS INVOLVING THE ILLEGAL USE OF A FIREARM, BUT IT WOULD GREATLY INTERFERE WITH THE USE OF FIREARMS BY LAWFUL INDIVIDUALS FOR ALL LEGAL PURPOSES!!!
