Upon the vote of a majority of nonrecused active judges, it is ordered that this case be reheard en banc pursuant to Federal Rule of Appellate Procedure 35(a) and Circuit Rule 35-3. The three-judge panel opinion and order denying motions to intervene shall not be cited as precedent by or to any court of the Ninth Circuit.

If the full court decides to overturn, Peruta appeals to SCOTUS, will SCOTUS take the case? If not, then Californians continue to be unable to bear arms.

If the full court upholds the panel's ruling, Harris and friends appeal to SCOTUS, does SCOTUS take the case? If not, then there is a split amongst the various circuits, but the 9th circuit will be able to bear arms. If they do take the case, there will be an opportunity for the court to flesh out what exactly the 2nd amendment means when it says "bear arms". I think O'Scanlain did a great job doing just that in his opinion in Peruta. This needs to be settled once and for all.
