Can antlers be sold.

I don’t think they can in California but I have a friend that wanted to sell a set from Wyoming. There legal plugged and from a hunt along time ago but they aren’t full curl and he wanted to see if he can sell them. Does anyone know the laws or loopholes? Can he sell them from here to someone out of state?

No, but here is the grey area or exception...A white-tail deer, fallow deer, etc, are NOT found in California.

(a) Except as otherwise provided in this section, Section 2023, Section 3087, Section 4303, another provision of this code, or a regulation adopted pursuant to this code, it is unlawful to sell or purchase a bird or mammal FOUND IN THE WILD OF CALIFORNIA.

(b) Shed antlers, or antlers taken from domestically reared animals that have been manufactured into products or handicraft items, or that have been cut into blocks or units that are to be handcrafted or manufactured into those articles, may be purchased or sold at any time. However, complete antlers, whole heads with antlers, antlers that are mounted for display, or antlers in velvet may not be sold or purchased at any time, except as authorized by Section 3087.(c) Notwithstanding Section 3504, inedible parts of domestically raised game birds may be sold or purchased at any time.

Well, the Communist States of Commiefornia Department of Fish and Wildlife won't even let you import certain legally taken game trophies (like an elephant tusk, for example) from the other side of the world. What makes you think they'd let you sell antlers from anywhere, even if they were sheds you found on your roof the morning of December 25th?

The laws and regulation are intended to be confusing. It makes it easy for them to pull out some obscure rule and give you a citation, stating ignorance to the law is no excuse. I have seen many members here and other outdoor site ask questioned they could not find the answer to after reading regs. or doing online search of DFG web page. As Hatch so often says, it's meant to hurt guys.

The big issue here with F&W is that most do not understand the difference between criminal law' which states what we CAN'T do', i.e., you can't murder someone. While F&W laws are prima Facia laws, which state what we can do, or use; if F&W law does not list "it" then it is illegal. Once again if F&W law does not say you can do it, it is illegal. It really is that simple. So in short, if you are questioning F&W law about something, and it's not clear, it is likely not legal.

I don't get the confusion on this matter (mule deer antlers)...If it's an game animal or bird that is not raised in captivity that lives in California...Then it's illegal to sell...White-tail do not live in Cali, alligators don't live in Cali, Coues deer (white-tail) don't live in Cali, caribou do not live in Cali...Mule deer & elk do live in Cali....Wolves would be a good test case......

Could you argue your mule deer is different .O. h. hemionus – Rocky Mountain mule deer vs O. h. californicus – California mule deer....I guess you could and have a good argument IMO, but then you're probably leaving it up to some tree hugging judge...........

ps....As far as fowl?...It has always been illegal to sell, trade, or barter migratory game birds...Mallards, pheasant, and bobwhites can be pin raised and sold.........

As a kid i used to go dumpster diving at the toys r us in burbank and found a plaque with antlers and sold them for 5 buck s I guess I broke the law

Long time back when I worked at HQ as a SA there was a GW who came in twice a week as a retired annuitant. His explanation of FG code was exactly as you put it. Assume everything is illegal unless it says otherwise, really helped my understanding of reading and interpreting the code after that.

I grew up on a exotic duck farm. My stepdad was a breeder of exotic birds. I believe you can sell fowl. But you have to have all the right federal licenses and keep records annually to do so.
